The stretch of Interstate 35 from Austin to San Antonio has long been a hazard to drivers. Not only do accident between standard vehicles occur regularly, but also, due to heavy commercial use on this stretch of interstate, there are dozens of collisions every year involving semi-trucks.

 

Our experience with 18-wheeler collisions on I-35

In January of 2013 we represented a victim of a car versus 18-wheeler collision which occurred on I-35 near Kyle, just outside of San Marcos Texas. The at-fault driver in this case was the 18-wheeler truck driver. The commercial truck he was driving was owned and operated by a large company.

While attempting to change lanes, the semi-truck came into contact with our client’s vehicle, a small four-door sedan. Our client’s vehicle sustained only minor damages (see images below), but our client suffered substantial injuries as a result of the collision with the 18-wheeler. The injuries ended up requiring several surgeries to address our client’s back and neck problems.

In court, the lawyers for the Defendant made the argument that the injuries to our client inside the four-door sedan could not possibly have been substantial considering the minor nature of the damages to her vehicle.

Anticipating this argument from the beginning, we hired one of the most well respected biomechanical engineers in the country to help the jury understand the forces involved in such a collision. With the help of this expert, we were able to clearly demonstrate that the client’s injuries were consistent with the applied forces in the collision, and ultimately achieve a $709,324.65 net recovery for our client.
